Introduction

These Terms of Use constitute a legal agreement between onWebChat ("onWebChat", "we", or "us") and you ("you") regarding the services provided through the ONWEBCHAT.COM website. Please read these terms carefully before using our services. By clicking "I accept" during registration or by using our services, YOU ACCEPT AND AGREE TO ALL TERMS AND CONDITIONS OF THIS AGREEMENT, and affirm that you are authorized to act on behalf of the account owner. If you do not agree to these terms, please do not use our services.

We reserve the right to modify, add, or remove portions of these Terms of Use at any time, at our sole discretion, and without prior notice.

Services

To use our services, you must complete the registration form on the "Register" page. You must provide truthful and accurate information as requested. During registration, you will need to specify an email address and a password for your account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. onWebChat reserves the right to refuse registration or cancel an account if deemed necessary.

Some of our services are free, while others are offered for a monthly or annual fee. The fee depends on the specific services you select. You may upgrade or downgrade your plan at any time, and your billing will be adjusted accordingly.

onWebChat makes every effort to ensure continuous access to our services. However, you acknowledge that there may be times, both scheduled and unscheduled, when the services are unavailable. We will notify you in advance of planned maintenance. Despite our best efforts, onWebChat is not liable for any losses resulting from service downtime.

Due to the wide variety of web browsers and versions, onWebChat cannot guarantee that the chat widget will display flawlessly for every visitor. In certain outdated browsers, the chat window may not render correctly. We are not liable for display issues or if installing the chat widget affects your website's layout. It is your responsibility to ensure your website functions properly after installation.

AI Services & Accuracy

The AI chatbots utilize third-party Large Language Models (LLMs), including OpenAI's GPT API. You acknowledge that AI systems may produce "hallucinations" or outputs that appear factual but are incorrect. onWebChat provides no warranty regarding the accuracy, completeness, or reliability of AI-generated content. You, as the "Operator," are responsible for monitoring and verifying AI responses to your visitors.

onWebChat disclaims all liability for losses, claims, damages, penalties, or costs arising from or related to AI-generated outputs, including outputs that are misleading, incomplete, unlawful, or otherwise incorrect. You remain solely responsible for any decisions, representations, offers, pricing, contractual commitments, or communications made to visitors through your chatbot.

AI Transparency Obligations: In compliance with the EU AI Act (2026), if you enable AI features, you are solely responsible for ensuring that your website visitors are informed that they are interacting with an artificial intelligence system. onWebChat provides the tools for this disclosure, but the legal obligation to ensure transparency remains with you.

Limitations and Restrictions

You agree not to use the services for any use or purpose that:

1. Breaches any applicable local, state, or federal laws
2. Is defamatory, blasphemous, pornographic, incites hatred, crime, terrorism, or any other offense
3. Is misleading, for example, by presenting yourself as someone else
4. Violates the intellectual property rights of others

You are not permitted to use our AI chatbot for the following purposes:

1. Illegal activities or any actions that exploit or harm children.
2. Generating hateful, harassing, or violent content that targets individuals or groups based on their identity, or that promotes violence.
3. Creating malware or code designed to disrupt or damage computer systems.
4. Activities that carry a high risk of physical harm, including weapons development or management of critical infrastructure.
5. Generating content that promotes self-harm, eating disorders, or acts of violence.
6. Activities that carry a high risk of economic harm, such as multi-level marketing, or making automated eligibility determinations for credit, or public assistance.
7. Fraudulent or deceptive activities, including scams, fake reviews, or disinformation.
8. Producing adult content, including content meant to arouse sexual excitement (excluding sex education and wellness).
9. Political campaigning or lobbying, including generating campaign materials or building products for political purposes.
10. Violating people's privacy, including tracking individuals without consent or unlawfully collecting or disclosing personal information.
11. Engaging in the unauthorized practice of law, providing tailored legal or financial advice without qualified review, or offering medical diagnoses or treatment instructions.
12. Creating or distributing deepfakes, fake news, or other misinformation intended to deceive or manipulate individuals or the public.
13. Using the AI chatbot for biometric categorization, biometric profiling, or social scoring of individuals based on behavior, personal traits, or inferred characteristics.

Please note that our AI chatbot is not designed to provide legal, financial, or medical advice, and should not be used for these purposes. We urge users to exercise caution and ensure that their use of our AI chatbot complies with all applicable laws and regulations.

We reserve the right to revise our usage policies, including the monthly conversation limits (for the free plan) and the chat history retention period. Plan pricing is subject to change at any time. The prices listed on our website are always the current rates. Paying customers will be notified in advance via email of any price changes.

By subscribing to a paid plan (via credit card or PayPal): (i) you confirm that you are authorized to use the chosen payment method, and (ii) you authorize onWebChat to automatically charge your payment method for all account-related fees on a recurring basis (monthly or annually) until you cancel your subscription.

Subscription fees apply as long as your account is active, regardless of usage. To stop future charges, you must cancel your subscription before the next billing cycle. Upon cancellation, your paid plan will remain active until the end of the current paid period, after which your account will be downgraded to the free plan.

Unauthorized use or resale of our services without prior written consent from onWebChat is strictly prohibited.

Refund Policy

We encourage users to try our service for free before committing to a paid plan. You can easily cancel your subscription at any time from your dashboard. There are no cancellation fees, but we do not offer prorated refunds for unused time. If you cancel, your plan will remain active until the end of the current billing cycle, after which it will downgrade to the free plan.

Third Parties

If you manage an onWebChat account on behalf of a third party, or if a third party uses the service through your account, you represent and warrant that (i) you are authorized to act on their behalf and bind them to this agreement, and (ii) you will not share customer data with unauthorized third parties.

Security Disclosure Policy

If you believe you've discovered a security issue, please see our disclosure procedure at Security Policy. Please note: we do not run a bug bounty program or offer financial compensation.

Proprietary Rights

This agreement grants you access to onWebChat's services but does not convey any software licenses. You may not, directly or indirectly: reverse engineer, decompile, or attempt to discover the source code, algorithms, or underlying data of our services. You may not remove or modify any service information or create derivative works. Your account is for the exclusive use of your business, and you may not share or resell the services to third parties.

onWebChat, onwebchat.com, and all associated logos, trademarks, product names, and trade names are the exclusive property of onWebChat. You may not use any of our trademarks or product names without our express written consent.

onWebChat reserves the right, at its sole discretion, to suspend or terminate your account at any time if we determine that you have violated any of the terms and conditions set forth in this agreement.
